Welcome to Gardener Hayes. Please read these Terms and Conditions carefully before using our services. By accessing or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By engaging Gardener Hayes for your gardening needs, you accept and agree to be bound by the terms and conditions outlined herein. If you do not agree with any part of these terms, you must not use our services.
2. Services Provided
Gardener Hayes offers a range of gardening services including, but not limited to:
- Landscape design and installation
- Regular garden maintenance
- Planting and transplanting
- Weed control
- Pruning and trimming
- Seasonal clean-ups
All services are subject to availability and Gardener Hayes reserves the right to modify the scope of services at any time.
3. Payment Terms
Clients are required to pay for services rendered by Gardener Hayes as per the agreed-upon schedule. Payments can be made via cash, check, or electronic transfer. Invoices will be issued upon completion of services unless otherwise specified in the service agreement.
3.1 Late Payments
Late payments may incur additional fees. Gardener Hayes reserves the right to suspend services until outstanding payments are settled.
4. Cancellation Policy
Clients may cancel scheduled services by providing at least 24 hours' notice. Cancellations made within 24 hours of the scheduled service may be subject to a cancellation fee to cover administrative costs.
5. Liability Limitations
Gardener Hayes strives to provide high-quality gardening services. However, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services. This includes, but is not limited to, loss of plants, property damage, or personal injury.
5.1 Force Majeure
Gardener Hayes is not responsible for delays or failures to perform services due to circumstances beyond our control, including natural disasters, acts of government, or other unforeseen events.
6. Intellectual Property
All content provided by Gardener Hayes, including designs, plans, and written materials, are the intellectual property of Gardener Hayes. Clients are prohibited from reproducing, distributing, or using this content without explicit written consent.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardener Hayes operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the local courts.
8. Changes to Terms
Gardener Hayes reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.
9. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
10. Entire Agreement
These Terms and Conditions constitute the entire agreement between the client and Gardener Hayes regarding the use of our services, superseding any prior agreements.
11. Amendments
No amendment to these Terms and Conditions will be effective unless it is in writing and signed by an authorized representative of Gardener Hayes.
12. Indemnification
Clients agree to indemnify and hold harmless Gardener Hayes from any claims, damages, or expenses arising out of the client's use of our services or violation of these Terms and Conditions.
13. Privacy
Gardener Hayes is committed to protecting the privacy of its clients. Personal information collected during service agreements will be used solely for the purpose of providing services and will not be shared with third parties without consent unless required by law.
14. Feedback and Suggestions
Clients are welcome to provide feedback or suggestions regarding our services. While Gardener Hayes appreciates such input, it is not obliged to implement any feedback received.
15. Assignment
Clients may not assign or transfer any rights or obligations under these Terms and Conditions without the prior written consent of Gardener Hayes.
16. Waiver
The failure of Gardener Hayes to enforce any right or provision of these Terms and Conditions will not be deemed a waiver of such right or provision.
17. Notices
All notices under these Terms and Conditions must be in writing and will be deemed effectively given when delivered in person or sent by recognized overnight delivery service to the address provided in the service agreement.
18. Headings
Headings used in these Terms and Conditions are for convenience only and do not affect the interpretation of any provisions.
19. No Third-Party Beneficiaries
These Terms and Conditions are intended solely for the benefit of the client and Gardener Hayes and do not confer any rights or benefits to any third party.
20. Survival
The provisions of these Terms and Conditions that by their nature should survive termination will survive, including but not limited to liability limitations and indemnification clauses.
By using Gardener Hayes' services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
